(1) Notwithstanding anything contained elsewhere in this paragraph, permission shall be obtained from the Board before registering the following industries:-
(a) Industries mentioned in Schedule-1,
(b) Industry requiring approval of the Board according to the prevailing laws regarding foreign investment and technology transfer.
(2) A person who wants to register an industry that requires permission according to sub-section (1) must submit an application to the board through the industry registration body in the prescribed format along with the prescribed details.
(3) Upon examination of the application and related documents as per sub-section (2), if necessary details and documents are found to be attached, the industry registration body shall submit it to the board for decision along with its opinion.
(4) According to this section, the board should decide within one month whether or not to allow the industry to be registered.
(5) According to sub-section (4) if there is a decision to grant permission from the board, within fifteen days from the date of receiving the information of such decision, the industry registration body shall issue the permission letter in the prescribed format.
(6) After receiving the permit, an application for industry registration should be submitted within the time period mentioned in the permit.
(7) According to sub-section (4), if the board decides not to grant permission to register the industry, the agency registering the industry shall inform the applicant within seven days.
